I can certainly see why ICE would be worried that a Guatemalan, once in the US for even the most heartwarming reasons, might decide not to go back, especially if he’s got close relatives here. Perhaps we could have a mechanism for someone to post a large enough bond to ensure compliance. Could you get that crowd-funded?
The mechanism for a bond exists but “should rarely be used.” See https://fam.state.gov/fam/09FAM/09FAM040101.html. I have never actually seen it come up in my practice so I guess it is indeed rarely used.
